Whistleblower Policy for Fundamaya (Fundación Familia Maya)

**Article I – Purpose**

Fundamaya is committed to maintaining the highest standards of ethical conduct in all its operations. This Whistleblower Policy aims to encourage and protect individuals who report unethical behavior, violations of laws, or organizational policies. The policy provides a safe avenue for reporting such concerns without fear of retaliation.

**Article II – Scope**

This policy applies to all board members, employees, volunteers, contractors, and agents of Fundamaya. It covers any concerns regarding unethical conduct, including but not limited to:

- Fraud or financial impropriety
- Violations of laws or regulations
- Misuse of Fundamaya resources
- Harassment or discrimination
- Violations of Fundamaya policies

**Article III – Reporting Violations**

1. **Encouragement to Report**: Individuals are encouraged to report any suspected violations in good faith. Reports can be made anonymously if desired.
 
2. **Reporting Channels**: Concerns should be reported through one of the following methods:

3. **Documentation**: All reports should include as much detail as possible about the incident, including dates, times, locations, and individuals involved.

**Article IV – Investigation Process**

1. **Acknowledgment**: Upon receiving a report, the designated Whistleblower Committee will acknowledge receipt within five business days if the reporter is known.

2. **Investigation**: The committee will investigate all reports promptly and thoroughly while maintaining confidentiality to the extent possible.

3. **Outcome Reporting**: After the investigation is complete, the committee will inform the reporting individual (if known) about the findings and any actions taken.

**Article V – No Retaliation**

Fundamaya prohibits any form of retaliation against individuals who report concerns in good faith. Retaliation includes adverse actions such as termination, demotion, harassment, or any other form of discrimination against the whistleblower.

**Article VI – Acting in Good Faith**

Individuals reporting concerns must act in good faith and have reasonable grounds for believing that the information disclosed indicates a violation of this policy. Any allegations found to be knowingly false or malicious may result in disciplinary action.

**Article VII – Confidentiality**

All reports will be treated confidentially to protect the identity of the whistleblower. However, confidentiality cannot be guaranteed if disclosure is required by law or necessary to conduct a thorough investigation.

**Article VIII – Policy Review**

This policy will be reviewed annually by the Board of Directors to ensure its effectiveness and compliance with applicable laws and regulations.
